CodeSoupCafe Terms of Service

In these terms, "we" means CodeSoupCafe LLC. "You" means the person who uses one of our apps. If you use an app for an organization, "you" also means that organization, and you confirm that you can accept these terms for it.

These terms are a contract between you and us. Read them with our Privacy Policy. If you do not agree to these terms, do not use our apps.

Sections 10, 11, and 12 limit our responsibility and your legal claims. Please read them.

How you accept. An app with an accept screen shows these terms before you can use the app. When you scroll to the end and continue, you accept them. Section 18 explains what happens for a new version and for an app with no accept screen.

Apps that these terms cover

Sections 1 to 19 apply to all our apps. The other sections apply as this list shows.

  • FreeFriend (Android, iOS, and the FreeFriend Agent Gallery pages on codesoupcafe.com): a personal assistant that records, transcribes, and answers with AI models that run on your phone. Sections 20 to 34 also apply. The app has an accept screen. It shows sections 1 to 34.
  • Surface Burn Calculator (installed copies on Android and iOS; the app is no longer in the stores): a tool that helps clinicians estimate total body surface area burned and fluid needs. Sections 35 to 39 also apply. Installed copies have no accept screen.

The full terms are at codesoupcafe.com/terms-of-service.

The main points

This list is a summary. The full terms below control.

  • Your data stays on your phone in most cases. We have no copy, so we cannot recover it.
  • AI output and calculations can be wrong. Check them before you act on them.
  • You must obey the recording laws where you are. Tell people when you record them.
  • You are responsible for each action that you approve or set to run without approval.
  • Our apps are not emergency services and do not replace a professional.
  • Each AI model has its own use rules. Sections 31 to 34 list them.

Terms for all our apps

1. Who can use our apps

You must be at least 18 years old to use our apps. You must also have the legal right to enter this contract in your country.

2. Your license to use the apps

We give you a personal, limited, non-exclusive, non-transferable license. You can install and use each app on devices that you own or control. You can use the app for personal or work purposes. The rules of the store that gave you the app also apply.

We and our licensors keep all other rights in the apps. Product names belong to their owners. We are not affiliated with those owners unless we say so.

3. Rules for your use

Do not do these things:

  • Break a law or violate the rights of another person.
  • Copy, sell, rent, or resell an app.
  • Reverse engineer an app, except when a law or an open-source license gives you that right.
  • Remove a copyright, license, or credit notice.
  • Bypass a purchase check, an ad, or a security or approval control.
  • Use an app to make malware, spam, fraud, or harassment.
  • Use an app to harm, overload, or attack a service or device.

4. Your content

Your content is what you record, type, import, or generate in an app. You keep your rights in your content. We claim no ownership of it, and we claim no ownership of AI output that an app makes for you. Other people or license terms can have rights in that output.

You are responsible for your content and for what you do with it. Our Privacy Policy explains where your content goes.

5. Your data and backups

Our apps keep most data on your phone in encrypted databases. We do not receive that data, and we have no copy of it. We cannot recover data if you lose your phone, uninstall the app, or lose access to a key.

Make your own copy of data that matters to you. The Privacy Policy shows what each app can export.

6. Ads and purchases

The free version of each app shows ads from Google AdMob. Privacy Policy section 2 explains the data that AdMob uses and shows which purchases remove ads.

Purchases go through Google Play or the Apple App Store. The store takes your payment. The refund rules of that store apply, and you ask that store for a refund. Laws in your country can give you more rights. A refund ends what you bought. Sections 26 and 38 give more details for each app.

7. Other services and products

An app can connect to a service or a device that we do not own. Examples are stores, AI providers, search engines, phone makers, and websites. We do not control them. We are not responsible for what they do, for their content, or for their prices. Their own terms and privacy policies apply. You must follow any third-party terms that apply when you use an app, such as your mobile data agreement.

The app can show a credit and a license for a web result, a place, or weather data. Follow that license if you reuse that information.

8. Open-source and other third-party licenses

Our apps include software, AI models, voices, and fonts from other authors. Each one has its own license.

If an app has a license page, open Settings > About > Open-source licenses. This page works offline. It shows each license, its components, and its full text. If an app has no license page, license notices come with each component. To get a list, email us.

Those licenses apply to those components. Nothing in these terms takes away a right that such a license gives you. If these terms conflict with such a license for a component, that license controls for that component.

9. Feedback

If you send us an idea, we can use it with no payment or duty to you.

An app can have a Feedback link that opens our feature-ideas board. Frill hosts the board, and anything that you post there goes to Frill. Do not post private information there.

10. No warranty

OUR APPS AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE LIMIT THAT THE LAW ALLOWS, WE GIVE NO WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. THIS INCLUDES WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

We do not promise that an app is free of errors, always available, or right for your phone. We do not promise that a feature, model, service, or device stays supported. We can change or remove a feature in an update.

11. Limit of liability

TO THE LIMIT THAT THE LAW ALLOWS, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. WE ARE NOT LIABLE FOR LOST DATA, LOST PROFITS, OR LOST RECORDINGS.

TO THE LIMIT THAT THE LAW ALLOWS, OUR TOTAL LIABILITY FOR ALL CLAIMS ABOUT AN APP IS THE GREATER OF: (1) THE AMOUNT THAT YOU PAID FOR THAT APP IN THE 12 MONTHS BEFORE THE CLAIM, OR (2) US$50.

Some places do not allow these limits. In those places, the limits apply only as far as the law allows. Nothing in these terms limits liability that the law does not allow us to limit.

12. Your responsibility for claims

To the limit that the law allows, you agree to pay for losses and reasonable legal costs from a claim by another person, if the claim comes from your content or from your breach of these terms. Examples are a recording that you made without the required consent, or an agent that you published. This section does not apply where consumer law forbids it.

13. Ending these terms

You can end these terms at any time. Stop using the app and uninstall it. Uninstalling removes the app data from your phone.

We can end your license if you break these terms. We can also block you from the Agent Gallery. We can stop offering an app. Sections 4, 10, 11, 12, 14, 15, 19, and the gallery license in section 30 stay in force after these terms end.

14. Governing law and disputes

The laws of the Commonwealth of Virginia, United States, apply to these terms, except for its conflict-of-laws rules. The Uniform Computer Information Transactions Act does not apply. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Before you start a claim, please email us. Give us 30 days to try to fix the problem. After that, the state courts in Henrico County, Virginia, and the federal courts for the Eastern District of Virginia hear any dispute. You and we accept the authority of those courts.

15. Consumer rights

Section 14 does not remove a consumer right that the law of your country gives you and that a contract cannot change. If you are a consumer in the EEA, the UK, or Switzerland, you keep the mandatory protections of your home country and you can bring a claim in its courts. Sections 10 and 11 do not limit liability for death or personal injury from negligence, for fraud, or for any other liability that your law does not let us limit.

16. Export and sanctions

You confirm that you are not in a country under a US Government embargo, or a country that the US Government names as a "terrorist supporting" country. You confirm that you are not on a US Government list of prohibited or restricted parties. You must obey export and sanctions laws when you use an app.

17. Apps from the Apple App Store

If you got an app from the Apple App Store, this section also applies:

  • These terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
  • Your license lets you use the app on Apple-branded products that you own or control, as the Usage Rules in the Apple Media Services Terms and Conditions permit. Other accounts linked to the purchaser can use it through Family Sharing or volume purchasing.
  • We alone provide maintenance and support. Apple has no duty to provide them. Use the contact in section 19.
  • If the app fails to meet an applicable warranty, you can tell Apple, and Apple refunds the purchase price of the app to you. To the limit that the law allows, Apple has no other warranty duty for the app. Any other claim, loss, or cost from that failure is our responsibility, subject to these terms.
  • We, not Apple, are responsible for claims about the app or your use of it. These include product liability claims, claims that the app does not meet a legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws. This includes our use of the HealthKit framework.
  • If a third party claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defense, settlement, and discharge of that claim.
  • Apple and its subsidiaries are third-party beneficiaries of these terms. When you accept these terms, Apple has the right to enforce them against you.

18. Changes to these terms

We can change these terms. When we do, we update this page, the version number, and the effective date. A change does not apply to a dispute that started before the change.

  • An app with an accept screen: for a new version, the app shows the terms again. You must accept them before you can use the app. If you do not accept a new version, stop using the app.
  • An app with no accept screen: installed copies cannot show these terms. A later version of the app will show them and ask you to accept. Until then, these terms apply if you keep using an installed copy.

19. General terms and contact

These terms and the Privacy Policy are the full agreement between you and us about the apps. If a court finds that one section cannot be enforced, the other sections stay in force. If we do not enforce a section, we do not lose the right to enforce it later. You cannot transfer these terms without our written approval. We can transfer them with a sale or reorganization of our business.

Terms for specific features

Each section applies to an app when it has that feature.

20. AI models on your phone

An app can run AI models on your phone. You choose and download the models. Models use storage, memory, and battery. Large models run best on recent, high-end phones. A model or a feature can run slowly or fail on your phone.

21. Recording other people

The earpiece and the phone microphone can record other people. You are responsible for each recording that you start.

  • Obey the recording and privacy laws where you are. Many places require consent from every person in a conversation.
  • Tell people when you record them.
  • Enroll a person's voice only after that person agrees.
  • If a person changes their mind, open Voice settings, open "Consenting participants", and tap Revoke. Privacy Policy section 12 explains what Revoke deletes.
  • Do not use an app to track or monitor a person without their consent.

Speaker filtering, voice labels, and quiet hours can make errors. Do not rely on them alone to meet a legal duty.

22. AI output and transcripts

AI models, transcripts, speaker labels, summaries, memory answers, image descriptions, and web answers can be wrong or incomplete. They can sound certain when they are wrong. Check them before you rely on them.

AI output is not medical, legal, financial, or other professional advice. Do not use it as the only basis for a decision that affects a person's rights, health, money, job, or housing.

We do not see what a model on your phone makes. To tell us about offensive output, use the Report action (section 30).

Our apps are not emergency services. Call your local emergency number in an emergency. Safety Check and other agents can fail, stop, or not run. Do not rely on them to get help.

23. Health questions

An app can read health data from Health Connect (Android) or Apple Health (iOS) to answer your health questions. Privacy Policy section 15 explains how the app uses that data. The app is not a medical device. Answers are for information only. Ask a qualified health professional about your health.

24. Agents, approvals, and automation

Agents and chat can use tools that act for you. Examples are text messages, email, contacts, calendar, connected services, and your Tasker tasks. Agents can also run on a schedule in the background.

The app asks for your approval before many actions. You are responsible for each action that you approve. You are also responsible for each action that you allow with "Always allow" or a similar setting. After that choice, the app can act and not ask you again. Read each approval before you accept it.

To undo "Always allow", open Advanced settings and tap Reset in the "Reset HIL Permissions" row.

A Tasker task does what you wrote in it, and it can send text to any place. You are responsible for your tasks. The app asks you when the text for a task holds personal data, even after "Always allow".

25. Connected services and servers

You can connect MCP servers, your Google account, a web search engine, or your own AI server. You can also turn your phone into an MCP server or an OpenAI-style endpoint.

  • Follow the terms of each service. This includes API plan limits, such as a plan that must allow AI use of results.
  • You are responsible for your API keys, your accounts, and any fees.
  • Data goes directly from your phone to the service that you use. Privacy Policy section 13 lists these services.
  • External transcription sends recorded audio to your server. That audio can include the voices of other people. You are responsible for the consent that this needs.
  • If you turn on external access to your phone, you control who connects. You are responsible for their use. Do not offer this access as a public or paid service.

26. FreeFriend free version, ads, and Premium

FreeFriend is free, with ads. There is no subscription. These are the options:

  • Rewarded ad: watch a short ad to the end. Premium features unlock for 2 days. Car control stays locked.
  • Remove Ads (one-time purchase): removes banner ads. It does not unlock features.
  • Premium (one-time purchase): removes ads and unlocks Premium features, including car control.
  • Upgrade to Premium (one-time purchase): if you own Remove Ads, pay the difference to unlock Premium features.

A one-time purchase has no monthly fee. It stays with your store account for as long as the store and the app support it. To restore it, use Restore purchases in the Premium settings. We can change, add, or remove Premium features in an update. We do not promise that a model, a device, or an outside service stays supported.

27. Vehicle control

The app can control a Tesla over Bluetooth when your phone is near the car. This needs the Premium purchase. Tesla is a trademark of its owner. We are not affiliated with Tesla, and Tesla does not support this feature. Your agreements with the car maker still apply.

You are responsible for the safety of your car and of the people near it.

  • Do not use this feature to distract you while you drive. Obey the road laws where you are.
  • Remote start lets anyone drive the car for about 2 minutes. Your phone can be outside the car. Use remote start only when you control who can reach the car.
  • Only remote start, lock, and unlock ask for approval. You can turn off the approval for lock and unlock. Other car commands run with no approval. Examples are trunk, frunk, climate, and honk.
  • Before you move a trunk, a frunk, or another moving part, make sure that no person, animal, or object is in its path.
  • A voice "yes" from the earpiece can approve remote start. A voice command or an AI model can be wrong.
  • A command can fail or be late. Check the car itself. Do not assume that it locked.

Llama models cannot control a car. The Llama use policy in section 33 forbids use with transportation technologies. Chat and agents do not get the car tools when the selected model has a Llama 3 or Llama 4 name. The app cannot detect a Llama model on an external server or under another name. Do not use a Llama model to control a car in those cases.

If a refund or a store change removes your Premium purchase, the app removes the stored car key and the car identifier from your phone.

28. Wearables

An app can work with Bluetooth earpieces, pendants, and glasses from other makers. These makers are not affiliated with us. We do not promise that a device works or stays supported. The maker's warranty and terms cover the device.

29. Other AI models

You can download models from Hugging Face or import your own model files. These models can have their own licenses and can come with no credit in the app. You must find and follow each license. We do not check or support models that are not in our catalogs.

30. FreeFriend Agent Gallery and shared agents

The gallery and QR codes let people share agents. By using the gallery, you accept these rules.

When you publish an agent or a review:

  • You must have the rights to what you publish.
  • You keep ownership of it. You can publish it in other places. You give us a permanent, irrevocable, worldwide, non-exclusive, royalty-free license to host, copy, sign, show, and distribute it, and to let people install and use it.
  • We owe you no payment for it.
  • Do not put personal data in it.
  • If you delete your gallery account, this license continues. We keep hosting the agents that you published. We remove your name and any link to you, and the agents stay listed as "by Anonymous".
  • If you delete your gallery account or we remove your agent, people who already installed it can keep using their copy.

Privacy Policy section 16 lists the data that we hold for the gallery. It also explains what we clear and how to delete your gallery account and your reviews.

Objectionable content is not allowed. Do not publish an agent, a name, an icon, or a review that:

  • sexualizes, exploits, or endangers a child,
  • is sexually explicit or made for sexual gratification,
  • promotes hatred, harassment, bullying, or violence,
  • encourages self-harm or other dangerous acts,
  • helps with a crime, including fraud, scams, or the sale of illegal goods,
  • contains or makes malware, spam, or deceptive instructions,
  • hides what the agent does, moves data without saying so, or tries to get around an approval or a safety control,
  • impersonates a person or a company,
  • exposes personal or private information, or
  • infringes the rights of another person.

Our review. We review each agent before it goes live. We can refuse or remove an agent or a review, or block a publisher, at any time, with or without notice. We count only the reviews that we approve toward a rating.

Report a problem. You can report offensive AI output, an agent, a review, or a publisher:

  • AI output: tap the reply in chat, then tap Report.
  • An agent: on the agent's page, open the options, then tap Report.

Report opens our report form in a browser inside the app. Nothing goes to us until you submit the form. The form sends only what you type. For an agent, it also names that agent. It does not send your chat, your recording, or the model's reply, so type or paste what we need to know. You can also email codesoupcafe+policy@gmail.com.

Copyright complaints. Send a copyright complaint to our copyright agent: Copyright Agent, CodeSoupCafe LLC, PO Box 28412, Henrico, VA 23228, United States, codesoupcafe+policy@gmail.com. We remove infringing content, and we block a publisher who infringes again and again.

Agents from other people. You choose which agents to install, from the gallery or a QR code. The app shows the trust status of each agent. A "Gallery" status means that we reviewed and signed that version. It does not promise that the agent is safe, correct, or right for you. Other people write these agents. Read what an agent does and what tools it uses before you run it.

Use restrictions for AI models

31. How these restrictions apply

An app can offer AI models from other companies. Their licenses require us to pass on these restrictions. The restrictions in sections 31 to 34 are binding terms of this agreement. They apply when you use the model that each section names, and any change or derivative of that model. Do not use these models for the listed uses, and do not let other people use them for those uses.

If you share one of these models with another person, you must follow its license. That includes giving them the license and these restrictions.

Settings > About > Open-source licenses holds a full copy of each license above. Other models, such as SenseVoice, have their own licenses on that page. Those licenses also apply to your use.

These notices apply:

  • "Gemma is provided under and subject to the Gemma Terms of Use found at ai.google.dev/gemma/terms."
  • "Built with Llama. Llama 3.1 is licensed under the Llama 3.1 Community License, Copyright © Meta Platforms, Inc. All Rights Reserved."
  • "Built with Llama. Llama 3.2 is licensed under the Llama 3.2 Community License, Copyright © Meta Platforms, Inc. All Rights Reserved."

The licensors can update their policies. The current version at the link applies. Google can restrict use of Gemma that it reasonably believes violates its terms. Sections 32 to 34 quote the licensors' words without change, as of November 4, 2026.

32. Gemma Prohibited Use Policy

    4. Attempts to override or circumvent safety filters or intentionally drive Gemma or Model Derivatives to act in a manner that contravenes this Gemma Prohibited Use Policy.
    5. Generation of content that may harm or promote the harm of individuals or a group, such as:
      1. Generating content that promotes or encourages hatred;
      2. Facilitating methods of harassment or bullying to intimidate, abuse, or insult others;
      3. Generating content that facilitates, promotes, or incites violence;

      5. Generating personally identifying information for distribution or other harms;
      6. Tracking or monitoring people without their consent;
      7. Generating content that may have unfair or adverse impacts on people, particularly impacts related to sensitive or protected characteristics; or
      8. Generating, gathering, processing, or inferring sensitive personal or private information about individuals without obtaining all rights, authorizations, and consents required by applicable laws.
  3. Generate and distribute content intended to misinform, misrepresent or mislead, including:
    1. Misrepresentation of the provenance of generated content by claiming content was created by a human, or represent generated content as original works, in order to deceive;
    2. Generation of content that impersonates an individual (living or dead) without explicit disclosure, in order to deceive;
    3. Misleading claims of expertise or capability made particularly in sensitive areas (e.g. health, finance, government services, or legal);
    4. Making automated decisions in domains that affect material or individual rights or well-being (e.g., finance, legal, employment, healthcare, housing, insurance, and social welfare);
    5. Generation of defamatory content, including defamatory statements, images, or audio content; or
    6. Engaging in the unauthorized or unlicensed practice of any profession including, but not limited to, financial, legal, medical/health, or related professional practices.
  4. Generate sexually explicit content, including content created for the purposes of pornography or sexual gratification (e.g. sexual chatbots). Note that this does not include content created for scientific, educational, documentary, or artistic purposes.

33. Llama Acceptable Use Policy

Sources: Llama 3.1 policy and Llama 3.2 policy.

This is the Llama 3.2 text. The Llama 3.1 policy has the same list, with "Llama 3.1" in place of "Llama 3.2", except that it does not have items 1(h) and 5 or the paragraph about multimodal models.

34. CreativeML OpenRAIL-M use restrictions

Source: Attachment A of the CreativeML OpenRAIL-M license, in Settings > About > Open-source licenses. It applies to Stable Diffusion 1.5 and LCM Dreamshaper v7.

You agree not to use the Model or Derivatives of the Model:

  • In any way that violates any applicable national, federal, state, local or international law or regulation;
  • For the purpose of exploiting, harming or attempting to exploit or harm minors in any way;
  • To generate or disseminate verifiably false information and/or content with the purpose of harming others;
  • To generate or disseminate personal identifiable information that can be used to harm an individual;
  • To defame, disparage or otherwise harass others;
  • For fully automated decision making that adversely impacts an individual's legal rights or otherwise creates or modifies a binding, enforceable obligation;
  • For any use intended to or which has the effect of discriminating against or harming individuals or groups based on online or offline social behavior or known or predicted personal or personality characteristics;
  • To exploit any of the vulnerabilities of a specific group of persons based on their age, social, physical or mental characteristics, in order to materially distort the behavior of a person pertaining to that group in a manner that causes or is likely to cause that person or another person physical or psychological harm;
  • For any use intended to or which has the effect of discriminating against individuals or groups based on legally protected characteristics or categories;
  • To provide medical advice and medical results interpretation;
  • To generate or disseminate information for the purpose to be used for administration of justice, law enforcement, immigration or asylum processes, such as predicting an individual will commit fraud/crime commitment (e.g. by text profiling, drawing causal relationships between assertions made in documents, indiscriminate and arbitrarily-targeted use).

Clinical calculators

Sections 35 to 39 apply to an app that calculates clinical values. Surface Burn Calculator is the only such app. These sections apply to copies that are still installed on Android and iOS. We removed the app from Google Play and the App Store.

35. For clinical professionals

The app is a calculation aid for trained clinicians. Use it only if you have the training to assess burns and manage fluid treatment, or under the supervision of a person who does.

36. Not medical advice and not a substitute for clinical judgment

The app gives estimates only. It does not diagnose or treat a patient, and it does not give medical advice. It does not replace your clinical judgment, your training, or the protocols of your workplace.

No regulator, including the US Food and Drug Administration, has reviewed or cleared the app. It is not sold as a medical device.

  • A result depends on what you enter and mark. A wrong age, weight, height, body type, or marked area gives a wrong result.
  • Check each result against your protocol and your own assessment before you act on it.
  • Do not use a result from the app as the only basis for a treatment decision.
  • Do not delay emergency care to use the app.

Sections 10 and 11 apply to the app and to its results.

37. Patient privacy

The app does not need a patient's name, date of birth, record number, or photo. Do not enter a patient's name or other identifier. You are responsible for following the privacy laws and the rules of your workplace when you use or share a chart. We do not receive charts or patient details from the app. See Privacy Policy section 17.

38. Accounts and purchases

You do not need an account to use the app. Sign-in no longer works, because we shut down its server. Privacy Policy section 18 explains what happened to earlier accounts and charts.

We no longer sell purchases or subscriptions for the app, and nothing renews. Earlier purchases stay in your store account, and the app honors what that account shows. Any purchase that your store account shows removes ads. Some chart exports need a purchase. If you do not have one, those exports are not available.

39. Exports

You can export a chart as a PDF, an image, or text. An export goes wherever you send it. You are responsible for it after that. Check an export before you share it or add it to a patient record.
